Charles Schumer, senator from New York, has said that, should our beloved President go through with elevating Clarence Thomas to the position of Chief Justice when William Rehnquist retires, ther would be a serious senate fight. Schumer is one of the architects of the filibuster attack on judicial nominees that sidelined 11 appellate appointments. In a typical display of the true Democratic party position on race, a disproportionately high number of filibustered nominees have been black or hispanic. This ought to be no surprise from the party whose Senate dean is a former KKK member.
I heard the well-justified anger emanating from Sean Hannity this afternoon. At first, I planned to join Hannity in condemning Sxhumer’s not-so-veiled racism, kicking him into the Hall of Shame. But I won’t do that. Please don’tget me wrong, Schumer is a bigot. He is a bigot just like all elitist leftists, and the mere idea of someone like a Clarence Thomas or a Condi Rice rising to the top of the GOP power circle, with no help from the paternalists, enrages these racists. To Schumer, Clarence Thomas is still the "uppity boy" that dared respond to the Senate with anger over the fabrications of Anita Hill. For the record, if Arlen Specter wins the chair at judiciary, please don’t despair; remember that he was Thomas’ passionate champion during those hearings.

Arlen Specter wants the judiciary chair so bad he can taste it. To get it, he will play footsie with the GOPcaucus, and that means an affirmative vote for the nuclear option. Assuming that Chaffee, Snowe and Collins still oppose the nuclear option, and Lieberman goes along with it (I think that he will based on his integrity, heck if the party keeps going left, ol’ Joe may be getting fitted for an elephant suit soon), we’ve got 53 votes, more than needed to fire the nuke.

What he did not say was that the Dems would try the "nuclear winter" option of halting all Senate business to avenge the use of the Nuke option, leading Dr. Frist to whip out the "thermonuclear option" -- using the nuclear method to eliminate the filibuster from Senate life forever. Schumer stopped short of promsing stalemate, thus leadig to the thermo option, destroying the last weapon that the libs have to try to force the Congress to make law by a supermajority.

Militant feminists are a core constituency of the Dems, and their hot-button issue is abortion. Justice Thomas will lead the court down the path of strict constructionism, and it’s a sure bet that the new Associate Justice (my pick: Miguel Estrada) won’t be a justice in the mold of Stevens or Ginsburg! Schumer is probably under extreme pressure to oppose any Bush pick to the court; he is also a realist and knows that obstructionism will do nothing to improve his party’s chances in 2006 or 2008, or beyond. President Bush has 3-4 picks coming his way. Rehnquist, Ginsburg, Stevens, O’Connor. He has a big say in the makeup of the court, because the people gave him their mandate.
So, we’ll hold off on Chuckie Schumer in the Hall of Shame. If the end result of his intransigence is the nuclear option, we’ll toast him as our judicial picks sail onto the bench at all levels. It may be that the Dems will blow enough hot air to placate their core constituencies, but not obstruct, in order to build support in the future. Either way, more kudos to Dr. Frist!
